Episode 108: Political Questions and Suppression of the Press (NPR, PBS)

Trump's Executive Orders continue to make headlines. This week, we are discussing Trump's continued reliance on the Alien Enemies Act to deport Venezuelans and a federal Texas court that has defied Trump on these deportations with its May 1, 2025 order.  
In the Texas case, J.A.V. v. Trump, Judge Fernandez Rodriguez, Jr., of the United States District Court for the Southern District of Texas, stopped the deportation of Venezuelans who are currently being held in a Texas prison awaiting deportation to El Salvador, ruling that there was no invasion of the United States by Venezuelans as required by the Alien Enemies Act. He also discussed the important legal theory of the "Political Question" doctrine. Through the Political Question doctrine, the U.S. Constitution says that there are specific powers designated to specific governmental branches. With respect to the President, the courts generally defer to the President as Commander and Chief when he acts in his capacity as a political actor with regard to foreign policy. However, in this case, Judge Rodriguez, Jr., decided that the Political Question doctrine does not apply when the President gives an arbitrary meaning to the specific language of the U.S. Constitution and other law. Therefore, Judge Rodriguez determined that the courts can review the President's use and application of the Alien Enemies Act and can make orders regarding that usage.
In other Executive Orders, Donald Trump ended direct and indirect federal funding to press outlets NPR and PBS and most federal funding to the U.S. Agency for Global Media (USAGM) that oversees the Voice of America. These Executive Orders have already eliminated hundreds of jobs at these agencies and have brought up constitutional questions of Freedom of the Press under the First Amendment.

Episode 107: Abrego Garcia and the Venezuelans : SCOTUS's emergency decisions

SCOTUS issued back-to-back emergency, lightning-fast decisions in two of the most hotly contested immigration cases in America: Noem v. Kilmar Armando Abrego Garcia, 640 U.S. ___ (2025) (4/10/2025) and A.A.R.P. v. Donald J. Trump, 640 U.S. ___ (2025) (4/19/2025). It is extremely rare for SCOTUS to issue emergency decisions, and it's even more rare for SCOTUS to issue preliminary injunctions. But in this episode of the legal weekly news, we dive into the significant and alarming due process violations the Trump Administration is committing against non-citizens and how the U.S. Supreme Court has responded with swift preliminary injunctions and orders against the Trump Administration.
First, the Trump Administration hastily deported Kilmar Armando Abrego Garcia from Maryland to the notoriously violent mega-prison, CECOT, in El Salvador, claiming he is an MS-13 gang member. U.S. District Judge Paula Xinis ruled that the government, which admitted it made an "administrative error" in this deportation, must facilitate the return of Garcia, but the Trump Administration appealed to the Supreme Court. In a unanimous decision, SCOTUS agreed that the government must "facilitate the return" of Abrego Garcia.
Since then, the government has alleged that it's up to El Salvador to return Abrego Garcia. Returning to the U.S. District Court, Judge Xinis has since ordered the government to demonstrate what efforts it has made to facilitate the return of Abrego Garcia.
Second, the Trump Administration was attempting to deport more Venezuelans from Texas to El Salvador, when an emergency appeal landed in SCOTUS. In a 7-2 decision, SCOTUS agreed that the plaintiffs should remain in the United States pending a decision as to whether the Trump Administration can deport them under the Alien Enemies Act. The case is now back up on appeal to the 4th Circuit Court of Appeals where Judge J. Harvie Wilkinson wrote the unanimous opinion saying that Trump is using his executive power to silence his enemies, which is creating an "incipient" constitutional crisis.

Episode 104: Big law firms cave to Trump's Executive Orders, but should they?

Big law firms are now Donald Trump's special targets in his Executive Order, and we sure have a lot to say about it!
Donald Trump's recent Executive Orders have targeted individual big law firms by naming them, getting rid of their security clearances, and disallowing government contracts. 3 of these firms are fighting in court, claiming that Trump's Executive Orders against them are unlawful and unconstitutional. At least one judge has already agreed with them, saying that Trump's actions against these law firms have a chilling effect on the law and on the practice of law. Another law firm caved, agreeing to provide $40 million in "free" legal services to Trump and his administration - even after the end of his presidential term. They also agreed to end all DEI programs and hiring practices so that Trump would withdraw his order against them.
Another big law firm, which was not yet named in an Executive Order, made a separate and preemptive deal with Trump for $100 million in "free" legal services so that they would not be named in an upcoming Executive Order.
For the first time in history, an Executive Order has been issued against lawyers and law firms - even by individual name. What is the effect of these orders, can any attorney stop them, and are they even lawful and constitutional?

Episode 103: Trump deports Brown University Doctor against Court Order

President Donald Trump and his administration violated a THIRD federal district court order! This time, Donald Trump deported a Brown University doctor and professor. Trump's administration claims Dr. Rasha Alawieh's deportation was due to security risks from her native Lebanon, from where she was returning after a family trip. Officials found pictures of Dr. Alawieh at a funeral for a Hezbollah leader while visiting her native Lebanon, along with other pictures of Iranian leaders. Upon her return to the United States, Dr. Alawieh was detained and prevented from coming back into the country.
Attorneys immediately filed lawsuits to keep Dr. Alawieh in the country while her visa status was reviewed, with her lawyers claiming she was denied due process under the Constitution. US District Court Judge Leo Sorokin issued an order preventing her removal "without forty-eight hours prior notice to the Court." However, despite this court order, Dr. Alawieh was deported the same night.
Judge Sorokin demanded explanations from Trump's attorneys and administration, and the case continues in the court. In the meantime, members of Congress have already called for the impeachment of Judge Sorokin for his court order and for his disagreements with President Trump.

Episode 102: LEGAL ANALYSIS: Trump defies court order on Venezuelan gangs

President Donald Trump and his administration just violated ANOTHER federal district court order! This time, Donald Trump deported about 300 Venezuelans to El Salvador (to their notoriously violent prison) and to Honduras. Trump claims they were members of the Tren de Aragua Venezuelan gang and that their deportation was justified under his use of the Alien Enemies Act of 1798. Therefore, through Executive Order on March 14, 2025, the Executive Branch has tapped this war-related Act to deport hundreds of illegal immigrants outside of the normal immigration laws and procedures, and without due process of law.

Episode 101: SCOTUS says Trump must turn over $2 billion for USAID

#SCOTUS just struck Donald Trump down. On March 5, 2025, the Supreme Court ruled against Trump and the Government in a 5-4 decision, lifting the stay that prevented a federal District Court Judge's ruling against Trump from going into effect. Through Department of State v. AIDS Vaccine Advocacy Coalition, SCOTUS approved the District Court Judge's order requiring Trump and the Government to release $2 billion in federal aid that was previously approved and appropriated through Congress for organizations under the USAID umbrella. Four Justices, led by Justice Alito, issued a strong dissent to this decision, and Republicans are displeased with one of their nominated Justices.

Multiple courts have ordered preliminary injunctions of President Trump's recent executive orders and of Elon Musk's DOGE program. Donald Trump and Vice President J.D. Vance have suggested that the U.S. President does not have to follow court orders and that he may choose not to follow court orders. But does Donald Trump - or any U.S. President - have the right to do so?
