No privileged immunity for Trump for his criminal cases. The Michigan shooter's mother convicted of 4 counts of involuntary manslaughter. These are the week's hottest legal topics.
With this episode, we break down the D.C. Circuit Court of Appeals' unanimous (per curium) decision that Trump does not have executive privileged immunity for his actions relating to alleged election interference in 2020 and 2021. Our legal team gives opinions as to what will happen with Trump's request for a hearing from the entire D.C. Circuit Court of Appeals (hearing en banc) and his request for hearing by #SCOTUS.
We also discuss the shocking conviction in Michigan v. Crumbley, for the mother of the school shooter. After trial, a jury found her guilty of 4 counts of involuntary manslaughter even though she never did the shooting herself. Find out why the jury may have ruled that way and why the legal team thinks some of the trial evidence should not have been presented.
We round out the episode with the failed Mayorkas impeachment and the ethical issues facing Fani Willis because of her affair with the hired special prosecutor.

The second E. Jean Carroll defamation trial against #donaldtrump started this week with lots of fireworks! We saw antics from #donaldtrump and his lawyer Alina Habba, who was admonished multiple times by Judge Lewis Kaplan. Our legal team explains why the actions by #donaldtrump and attorney Alina Habba are not normal during trials and what behaviors are actually expected of attorneys and clients during a jury trial.
This week, we also pick up more topics! We also discuss the defamation claims brought by a man against about 27 women who spoke badly about him on the internet. We talk about the Iowa Caucus and where the presidential race now stands and about the new Uvalde report showing grave dereliction of duties by the officers who responded to the shooting at the elementary school.
Finally, we discuss the case before the Supreme Court that could have a monumental impact on administrative law. Since the 1980s, the case of Chevron U.S.A., Inc. v. NRDC (1984), has given government agencies wide latitude to interpret laws in implementing their policies. Now, a little case about fishermen could upend the case law. Hear our take on the cases of Relentless v. Department of Commerce and Loper Bright v. Department of Commerce.

Texas just enacted legislation to criminalize illegal immigration into Texas. The rule imposes fines and jail time on those convicted of these crimes. However, the Department of Justice just sued Texas, saying that Texas, as an individual state, cannot enact and impose separate and additional laws and sanctions on immigration that add to or contradict those imposed by the federal government. Find out from our Constitution and constitutional law experts whether the law is actually unconstitutional, and if so, why, as well as how the immigration issues are currently impacting Congress through proposed impeachment proceedings against the Secretary of Homeland Security.
In this episode, we also discuss the most recent legal briefs by Trump's team in the DC appellate court regarding his claims of presidential immunity and why we think that the U.S. President cannot be completely immune from prosecution. Trump was disqualified this week from the primary ballot in Colorado by the Colorado Supreme Court. In a 4-3 decision, the high court overturned part of the Colorado District Court decision in which Trump was found to have committed insurrection and rebellion according to Section 3 of the 14th Amendment but was also found not to qualify as an "officer" under the Constitution. Two cases were appealed to #scotus this past week. 2 defendants in January 6th criminal cases have appealed to the Supreme Court to determine whether the criminal obstruction of a government proceeding charges are constitutional. The Supreme Court's decision will have implications on the D.C. criminal charges against #donaldtrump, because he has also been charged with those two particular crimes.
Also this past week, federal special prosecutor Jack Smith requested an emergency hearing and acceptance for review of #donaldtrump 's D.C. criminal cases on the sole issue of whether he is immune from criminal prosecution related to his conduct on January 6th through presidential immunities. #scotus has asked Trump's legal counsel to file responsive briefs by December 20th. Jack Smith is seeking to by-pass the intermediate appellate court.
Impeachment proceedings continue in Congress against President Joe Biden, and the Supreme Court takes on the abortion pill case.

Two different courts ruled against #donaldtrump on December 1, 2023. In Blassingame v. Trump, the U.S. Court of Appeals for the District of Columbia decided that Trump does not have immunity from civil suits related to his actions surrounding January 6th. They ruled that there is a difference between the actions of a President, which would allow immunity, from the actions as a presidential candidate. Therefore, the civil case against #donaldtrump by police officers and members of Congress can go forward against him.
In the criminal case of United States v. Trump in D.C., U.S. District Court Judge Tanya Chutkan ruled that Trump does not have immunity from criminal charges either for his actions surrounding the presidential election and contest. Therefore, the criminal case against #donaldtrump by federal prosecutor Jack Smith for conspiracy and obstruction can also move forward against Trump.
