Episode 23: The Supreme Court and Native American Rights

#SCOTUS is issuing their June decisions, and they are HOT this summer of 2023! Habeas Corpus rights, Native American rights, and racial redistricting in Alabama all make their appearance on this week's episode of The Legal Weekly Wine.

VIP Products LLC (2023). In this case, SCOTUS ruled unanimously in favor of Jack Daniel's, deciding that a dog toy company's creation of a squeaky toy for dogs that looked a lot like Jack Daniel's, but which referenced No. 2, was an infringement of Jack Daniel's trademark.

The case of E. Jean Carroll v. Donald Trump is over, and the jury awarded $5 million to Ms. Carroll. Former President Trump was found liable of sexual assault and defamation. However, Judge Kaplan has warned Mr. Trump that he could be facing more legal complications if he continues to talk about Ms. Carroll and this civil case in the public. President Trump now says that he was denied the right to defend himself, but is this true?
The United States has indicted House Representative George Santos on 13 felony federal indictments this week. Get started with a summary of the case of United States v. George Santos in the Eastern District of New York and his 13 felony indictments for various alleged fraudulent schemes. Find out our take as to whether Mr. Santos can be removed from Congress and how his criminal case in Brazil may affect his current case in New York.

Episode 17: Richneck School Shooting & Alvin Bragg’s lawsuit against Congress

The 6-year-old Richneck Elementary School shooter was not charged with any crimes. But this week, his mother was indicted on a charge of felony child neglect and a misdemeanor gun crime. The victim, teacher Abby Zwerner, has sued some Newport News school administrators for gross negligence over the shooting, claiming that they were warned of the threat and failed to act. Our legal team previously talked about this shooting and the possible civil and criminal legal implications of the act. In this episode, we revisit our prior predictions (which came true!) and provide legal updates on this case.
New York City's District Attorney Alvin Bragg is back in the news this week, too. This time, he has filed a lawsuit in the federal court for the Southern District of New York against Republican Representative Jim Jordan, the head of the House Judiciary Committee for Congress. He is asking the court to stop two subpoenas that were issued by the House Judiciary Committee to one of Bragg's former and current employees to testify before Congress. Is he right? Can these subpoenas be quashed? Ultimately, these are questions of federalism, state prosecutions, and Congress's purpose in issuing the subpoenas.
